			<content:encoded><![CDATA[<p>This document will describe the functionality and purpose of the  UniversalMixMachine web service, provided by Moodmixer GmbH.</p>
<p>The UniversalMixMachine web service provides users with an online tool that delivers a calculated and in length defined list based on almost arbitrary data and a history of previously delivered items. Typical use cases are musical play lists, dynamic product presentations or recommendations for web visitors. Since the UniversalMixMachine calculates the returned list by a complete analysis of base data and logs the result will always be different from previous lists and absolutely up to date at the same time. The process can be fully automated, what makes it possible to deliver user related content dynamically without any further interaction.</p>
<p>The selection of items is conducted on the basis of threee possible algorithms. These can be combined and put into a weighed order. Each algorithm can be used for different metadata.</p>
<p><strong>Ranking:</strong><span style="font-size: 10pt;" lang="EN-US"> The principle of all Moodmixer™-Systems<span> </span>is a rating system. The higher a track is being rated, </span><span style="font-size: 10pt;" lang="EN-US">the &#8220;relatively“( in relation to the title pool used) more often it will be used in a playlist. </span></p>
<p>Ranking columns can also be used for temporary archiving of tracks (value 0 equals “not in use” if activated). Ranking can be used on any kind of data that can be converted into a ranking, such as product age, price, editorial oder user-rating, click rates, sales charts, results from filters or semantic analysis, resuilts from collaborative filtering and many more.</p>
<p><span class="O1"><span style="font-size: 10pt;" lang="EN-US" xml:lang="EN-US"><strong>Group distribution </strong></span><span style="font-size: 10pt;" lang="EN-US" xml:lang="EN-US">(optional)</span><span style="font-size: 10pt;" lang="EN-US" xml:lang="EN-US"><strong>: </strong></span><span style="font-size: 10pt;" lang="EN-US" xml:lang="EN-US">The group algorithm will take care of a homogeneous distribution of values </span><span style="font-size: 10pt;" lang="EN-US" xml:lang="EN-US">that occur more often in a data library- i.e. if you have an artist in the library that owns many more songs </span><span style="font-size: 10pt;" lang="EN-US" xml:lang="EN-US">than others you might want to distribute all of his titles evenly across the playlist- without a bulk of songs at </span><span style="font-size: 10pt;" lang="EN-US" xml:lang="EN-US">one point- then you set &#8220;Group&#8221; to the Artist column. This is also a good way to control the distribution of i.e. </span><span style="font-size: 10pt;" lang="EN-US" xml:lang="EN-US">voice type or of product groups and their homogenious distribution. </span></span><span class="O"><span style="font-size: 10pt;" lang="EN-US">Group algorithms are &#8220;non-destructive&#8221;- if a title pool doesn&#8217;t </span></span><span class="O"><span style="font-size: 10pt;" lang="EN-US">allow for this distribution it will carefully soften the rule. </span></span></p>
<p><span class="O1"><span style="font-size: 10pt;" lang="EN-US"><strong>Smoothing </strong></span><span style="font-size: 10pt;" lang="EN-US">(optional)</span><span style="font-size: 10pt;" lang="EN-US"><strong>:</strong></span><span style="font-size: 10pt;" lang="EN-US"> This control can be set for values such as BPM, Tempo/ felt tempo, Rhythm-</span><span style="font-size: 10pt;" lang="EN-US">description etc. it aims to prevent too large differences in value change from one item to the next. If the title </span><span style="font-size: 10pt;" lang="EN-US">pool allows it then  changes will be made in waves, slowly increasing and decreasing. </span><span style="font-size: 10pt;" lang="EN-US">This control is also non-destructive. </span></span></p>
<p><strong>Overview:</strong></p>
<p>UniversalMixMachine web service has one core function called <span style="font-weight: bold;">UMMRun</span></p>
<h3>The used parameters:</h3>
<p>You need at least a PrimaryID for each planned item.</p>
<p>With this PrimaryID the user should be able to get additional information from his own database if necessary. The second entry will contain the calculated start time of the item, it will only be present if <a href="#ScheduleStartTime">ScheduledStartTime</a> is valid. The third entry will contain the URL of the calculated item if the <a href="#ColTypes">column type</a> is present. The length of the returned array depends of either the value in <a href="#ItemsReturn">ItemsReturn</a> or the amount of items used to fill the time given by <a href="#ScheduleStartTime">ScheduleStartTime</a> and <a href="#ScheduleEndTime">ScheduleEndTime</a>.</p>
<p>In any case the last two entries of the returned array will contain first the parameters passed to the function except <a href="#MixData">MixData</a> and <a href="#LogData">LogData</a> for control purposes and second a string that will be <span style="font-weight: bold;">&#8220;No Errors!&#8221;</span>, if everything worked fine. So, if an error occurred and the function was able to return the object array, it will be just two entries long. One can say for a rule that, if the returned array length is lower or equal two, something went wrong.</p>
<p>The parameters:</p>
<p>All <span style="font-weight: bold;">UMMRun</span> function parameters are of type string to avoid any type mismatch. But there are some crucial aspects that should have special attention:</p>
<p>All four parameters <a href="#ColTypes">ColTypes</a>, <a href="#ActiveColumns">ActiveColumns</a>, <a href="#ColumnRestrictions">ColumnRestrictions</a> and <a href="#ColRanks">ColRanks</a> must exactly reflect the amount of columns in . I.e. if  has 4 columns <a href="#ColTypes">ColTypes</a> must also contain 4 numbers separated by a &#8216;;&#8217;: &#8220;0;2;9;11&#8243;</p>
<p><a href="#MixData">MixData</a><a href="#LogData">, LogData</a> must be separated by the same <a href="#ColumnSeparator">ColumnSeparator</a> and <a href="#ColumnSeparator">RowSeparator</a> and these separators should be <span style="font-weight: bold;">safe</span>, means, neither <a href="#MixData">MixData</a> nor <a href="#LogData">LogData</a> entries should contain them.</p>

All other column types are optional but DurationInSeconds should be present, if exact timing is important, otherwise the &lt;%UMM%&gt; will assume a default duration value.</p>

<p>Last Updated: January, 23rd 2009 MOODMIXER GmbH (formerly MOODMIXER) recognizes the importance of protecting the privacy of all information provided by users of our web sites, recipients of our e-mail newsletters, users of our software and web services and all other customers of our products and services. We created this policy with a fundamental respect for our customers’ right to privacy and to guide our relationships with our customers. This Privacy Statement discloses the privacy practices for all products and services owned by MOODMIXER .</p>
<p>INFORMATION COLLECTION AND USE</p>
<p>MOODMIXER collects information from our website users, subscribers and other customers. In this section of our Privacy Statement, we describe the type of information we collect and how we use it to provide better services to our customers.</p>
<p>Registration and Ordering</p>
<p>When using some of our websites and signing up for certain selected services (such as fplaylist accounts), users must first register. During registration, users are required to give their contact information (such as name, e-mail address, mailing address and phone number). For internal purposes, we use this information to communicate with users and provide requested services, and, for our website visitors, to provide a more personalized experience on our sites. We also may collect information about a user’s professional responsibilities (such as job title, purchasing responsibilities, company information and professional certification). We use such information to improve our service, for marketing purposes and/or for industry reporting purposes. Many of our products and services are free to subscribers who meet certain demographic criteria.</p>
<p>For our services that require payment (such as certain products and subscriptions), we also collect credit card information (such as account name, number and expiration date), which is used for our or our agent’s billing purposes only, and is not otherwise shared.</p>
<p>E-mail Newsletters</p>
<p>If users wish to subscribe to our e-mail newsletters, we ask for contact information (such as name, e-mail address and phone number) and information about the subscriber’s professional interests and responsibilities. We use this information in the same manner as we use contact information in the registration and ordering process described above. Recipients of our newsletters can unsubscribe using the instructions listed at the end of the e-mail newsletter.</p>
<p>Surveys and Contests</p>
<p>From time to time we invite web site users and other customers to provide information via surveys or contests. Participation in these surveys or contests is completely voluntary and the website user or other customer therefore has a choice whether to disclose requested contact information (such as name and mailing address) and demographic information (such as zip code or job title). <p>At some of our sites, we offer interactive and community features such as discussion boards and user profiles. Note that all personal information sent or posted via such features becomes public information for which we are not responsible.</p>
<p>Tell-A-Friend</p>
<p>If customers elect to use our referral service for informing a friend about our sites and services, we may ask them for the friend’s name, job title and e-mail address. MOODMIXER will store and use this information to send the friend an invitation. This information may also be used to provide information about our company and related products and services. The friend may contact us as specified in the tell-a-friend message to request that no further communications be sent.</p>
<p>Communications with Us</p>
<p>We have features where our customers can submit information to us (such as our feedback forms). Where such submissions include requests for service, support or information, we may forward them to our agents, as needed, to best respond to the specific request. In addition, we may retain e-mails and other information sent to us for our internal administrative purposes and to help us to serve customers better. Please note that letters to the editor and similar submissions may be made public.</p>
<p>Automatic Data Collection</p>
<p>Our web sites, newsletters and, from time to time, certain other products and services have features that automatically collect information from customers, to deliver content specific to customers’ interests and to honor their preferences. This information assists us in creating products and services that will serve the needs of our customers. For example, we use “cookies,” a piece of data stored on the user’s hard drive containing information about the user. Cookies benefit the user by requiring login only once, thereby saving time while on our web site. If users reject the cookies, they may be limited in the use of some areas of our web site. <p>By using the Moodmixer software and system components or any other services provided by Moodmixer GmbH you acknowledge that you have read and understood this agreement and you agree to be bound by this agreement&#8217;s terms and conditions. </p>
<p>You also agree that this agreement is the complete and exclusive statement of the rights and liabilities of the parties and supersedes all proposals or prior agreements, oral or written and any other communication between the parties relating to the subject matter of this agreement.<br />
  This copyright declaration, the &#8220;End User License Agreement&#8221; and disclaimers are based on and regulated by German law. </p>
<p>Below you find a legally non-binding translation of the paragraphs „Scope of application”, “warranty and liablility”, “copyright”, “applicable law and jurisdiction” as well as “salvatorian clause”. Only the wording of the German version of this EULA is decisive. All programs and documents were created based on German law. If there were any infringements of changed, international or any other applicable law, it is done unintentional. <h3>1.	SCOPE OF APPLICATION  </h3>
<p>These EULA, copyright declaration, terms and conditions apply to all services provided to users of MOODMIXER-Internet/Moodmixer INTRANET. Any amendments from these have to be specifically confirmed in writing by Moodmixer GmbH. In case of contradictions between any provision of the Moodmixer GmbH EULA and any other provision of EULA/terms and conditions, the provision of the Moodmixer GmbH EULA shall prevail. Moodmixer GmbH may at any time alter or change its terms and conditions and EULA.  </p>
<h3>2.	WARRANTY AND LIABILITY  </h3>
<h3>2.1 PLAYLIST SERVICE  </h3>
<p>The playlist service can only be accessed via internet connection or within an Intranet. If access to the webservice on the Internet or Intranet fails Moodmixer GmbH will not guarantee the availablility of access and can not be held liable fort he loss of the access.<br />
  If installed within a local INTRANET Moodmixer GmbH will not guarantee the accessibility within this network.<br />
  If access to the web-service is lost, The Moodmixer-Player software offers a fallback mode which will enable the playout to continue to play until access is restored.  </p>
<h3>2.2	MOODMIXER-INTERNET / MOODMIXER-INTRANET  </h3>
<p>Moodmixer GmbH have carefully developed and tested this system .The software, components and related documentation are provided to licensee &#8220;as is&#8221;. All express or implied conditions, representations, and warranties, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, or non-infringement, are disclaimed, except to the extent that such disclaimers are held to be legally invalid. This software is not fault tolerant and should not be used in any environment, which requires this, such as on-line control of aircraft.</p>
<p>  TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, MOODMIXER GMBH’S AGGREGATE LIABILITY TO LICENSEE OR TO ANY THIRD PARTY FOR CLAIMS RELATING TO THIS AGREEMENT, WHETHER FOR BREACH OR IN TORT, WILL BE LIMITED TO THE FEES PAID BY LICENSEE FOR THE SOFTWARE/SYSTEM WHICH IS THE SUBJECT MATTER OF THE CLAIMS. IN NO EVENT MOODMIXER GMBH WILL BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGE IN CONNECTION WITH OR ARISING OUT OF THIS AGREEMENT (INCLUDING LOSS OF BUSINESS, REVENUE, PROFITS, USE, DATA OR OTHER ECONOMIC ADVANTAGE), HOWEVER IT ARISES, WHETHER FOR BREACH OR IN TORT, EVEN IF MOODMIXER GMBH HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. LIABILITY FOR DAMAGES WILL BE LIMITED AND EXCLUDED, EVEN IF ANY EXCLUSIVE REMEDY PROVIDED FOR IN THIS AGREEMENT FAILS OF ITS ESSENTIAL PURPOSE.</p>
<p>  If a software bug will be found after contract start, Moodmixer GmbH will be liable for rectification (repairing the software) within a designated period. Client has to inform Moodmixer GmbH in case of a software bug in writing describing exact fault and its implications, if software is at fault Moodmixer GmbH will cure this fault within a reasonable time frame.  </p>
<h3>2.3 MUSIC DELIVERY  </h3>
<p>Moodmixer GmbH’s Player offers the functionality of downloading missing sound files from a given FTP-server.<br />
  In some cases it can happen that the music sound files are corrupted during transmission. Moodmixer GmbH will not guarantee the uncorrupted arrival of sound files and under no conditions will be held liable for corrupted sound files.<br />
  If the client notices a corrupted sound file it has to be deleted from the server and downloaded again.  </p>
<h3>3.	COPYRIGHT  </h3>
<p>Moodmixer GmbH- shall be credited as the owner of the MOODMIXER-SYSTEM in all distributions of the MOODMIXER-SYSTEM.<br />
  Moodmixer GmbH is the exclusive world-wide licenser of the MOODMIXER-SYSTEM, and the copyrights and other proprietary rights therein. You are only allowed to use the Moodmixer-System once you bought licenses; the MOODMIXER-SYSTEM is not public domain or free software or freeware.<br />

<h3> 4.	APPLICABLE LAW AND JURISDICTION  </h3>

  Moodmixer GmbH is based in and directs its operations from locations in Germany. All legal proceedings relating to the Moodmixer-System or the formation or interpretation of this Agreement shall be brought forward only in courts located in Germany. In case of proprietary conflicts the place of jurisdiction will be Hamburg/Germany.<br />
  You hereby expressly submit to the jurisdiction of such courts and consent to extra-territorial service of process.  </p>
<h3>5.	SALVATORIAN CLAUSE  </h3>
<p>If any provision of this AGREEMENT is held to be void, invalid or unenforceable, it will not affect the validity of the remaining provisions of this AGREEMENT, which shall remain valid and enforceable according to its terms and conditions.<br />
  Instead of the invalid/void provisions regulations of German Law are applicable. </p>
